Welcome to FairShare (“Owino”). By creating an account or accessing our platform, you enter into a legally binding contract under the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023. Please review these terms carefully.
FairShare is a non-banking social ledger tool designed solely for tracking shared expenses, calculating mathematical debt simplifications, and providing UPI deep-link routing.
FairShare does not hold user deposits, does not act as an escrow agent, does not process UPI funds directly through a proprietary wallet, and is not a financial intermediary under the Reserve Bank of India (RBI) Payment and Settlement Systems Act, 2007. All fiat transfers occur directly peer-to-peer between user accounts via authorized NPCI/UPI handles.
You must be at least 18 years old to create an account. In accordance with Section 9 of the Digital Personal Data Protection Act, 2023, personal data of individuals under 18 years of age requires verifiable parental or lawful guardian consent.
You are responsible for maintaining the confidentiality of your session credentials, JWT tokens, and OTP codes. You agree to notify FairShare immediately of any unauthorized access to your account.
Users are solely responsible for verifying the accuracy of expense descriptions, split ratios, amounts, and UPI Virtual Payment Addresses (VPAs).
FairShare provides debt simplification algorithms (min-cash-flow routing) to reduce bilateral transfers. While our algorithms are mathematically rigorous, FairShare disclaims liability for incorrect split allocations created by group administrators or erroneous UPI transfers initiated to incorrect phone numbers or VPAs.
FairShare operates as a Data Fiduciary under the Digital Personal Data Protection Act, 2023. We process your personal data (name, email, UPI VPA, expense shares) solely for lawful, specified purposes with your explicit consent.
You retain full statutory rights to access your data, request correction of inaccurate records, withdraw consent, request erasure upon settlement of debts, and file grievances with our designated Grievance Officer. For complete details, consult our Privacy Policy.
To the maximum extent permitted under applicable Indian laws, FairShare, its developers, and affiliates shall not be liable for any indirect, incidental, or consequential damages resulting from peer-to-peer default between group members, banking gateway downtimes, or telecommunications failures.
These Terms are governed by the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
